1. ADF files suit to stop violation of Wis. marriage amendment
Alliance Defense Fund attorneys together with allied attorneys representing Wisconsin Family Action officers and board members filed suit in state court Wednesday to stop the governor and state legislature from skirting a voter-approved constitutional amendment protecting marriage. The lawsuit asks the court to halt the state’s “domestic partnership” scheme because it creates a legal status substantially similar to that of marriage, which directly violates Article 13, Section 13, of the Wisconsin Constitution.

2. 9th Circuit puts brakes on decision that struck down Calif. marriage amendment
SAN FRANCISCO — The U.S. Court of Appeals for the 9th Circuit Monday put the brakes on an Aug. 18 implementation date for U.S. District Judge Vaughn Walker’s order overthrowing the will of 7 million California voters with regard to marriage.

6. ADF: American Bar Association can’t speak for all American lawyers on same-sex ‘marriage’
Two groups representing thousands of attorneys nationwide are disputing claims by the American Bar Association that it speaks for the legal profession in its plans to endorse same-sex “marriage” later this week. Attorneys associated with the Alliance Defense Fund and National Lawyers Association point out that about three-quarters of American lawyers don’t even belong to the ABA, and many actively work to protect marriage as the union of one man and one woman.

7. ADF to appeal ruling that allows Eastern Michigan U. to expel Christian students for holding to beliefs
Alliance Defense Fund attorneys will appeal a problematic federal court decision issued Monday in a lawsuit filed on behalf of student Julea Ward against Eastern Michigan University after it kicked out the Christian student for holding to her beliefs.  EMU dismissed Ward from its graduate counseling program in March 2009 for not affirming homosexual behavior as morally acceptable.  Ward would not agree to change her religious beliefs about homosexual behavior or express a message contrary to them during counseling sessions as a condition to receiving a degree.

8. NJ Supreme Court rejects demand to redefine marriage…for now
The New Jersey Supreme Court issued an order Monday rejecting a recently filed motion in a long-ago-resolved lawsuit that attempted to force New Jersey legislature to redefine marriage. Lambda Legal attorneys represented a small group of activists who were dissatisfied with civil unions implemented by the Legislature in 2007, and recently argued that they were not content with anything short of forcing a redefinition of marriage on all New Jersey residents. However, this latest order won’t likely be the end of this legal attack on marriage in the Garden State.

9. DC Court of Appeals: OK to lock out voters on marriage
Alliance Defense Fund and Stand4MarriageDC attorneys are considering an appeal to the U.S. Supreme Court after the U.S. Court of Appeals for the D.C. Circuit, in a narrow 5–4 ruling, upheld the decision of the D.C. Board of Elections and Ethics to block residents from voting on the legal definition of marriage, despite a requirement by the D.C. Charter that they be allowed to do so. The charter, which serves as a constitution for the district, guarantees citizens the right to initiate and vote on any legislation except for “laws appropriating funds.”

10. Mass. federal judge rules Defense of Marriage Act unconstitutional
A federal judge granted summary judgment Thursday to the Commonwealth of Massachusetts in a decision against the U.S. Department of Health and Human Services, which declares the Defense of Marriage Act unconstitutional. Judge Joseph L. Tauro of the Massachusetts District Court issued a ruling denying a USDHHS motion to dismiss a lawsuit brought on by the state, proclaiming that the federal DOMA, which defines marriage as one man and one woman, violates the 5th and 10th Amendments of the U.S. Constitution.
